This English text is provided for convenience. In case of any discrepancy, the Polish version prevails.
1. General provisions
These terms set out the rules for using the nalvica.com website, including the contact form, and the general rules for concluding service agreements with [Nalvica Sp. z o.o., registered office address, NIP, KRS — to be completed], hereinafter the "Service Provider".
2. Definitions
- Website — the website available at nalvica.com together with its subpages, in Polish and English.
- Client — a business, organisational unit or natural person using the Website, sending an Inquiry or ordering Services.
- Services — services provided by the Service Provider, in particular: IT audits, security audits, IT infrastructure maintenance and support, systems integration and deployment, DevOps and cloud services, AI and automation deployments, as described in the "Solutions" section of the Website.
- Inquiry — a message sent through the contact form on the Website or by e-mail.
- Initial consultation — a free, non-binding conversation (up to 30 minutes) to determine the Client's needs and the scope of possible cooperation.
3. Use of the Website
Use of the Website is free of charge and does not require registration. Content published on the Website, including descriptions of Services, indicative delivery times and example project results, is for information only and does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude a contract. Using the Website requires a device with internet access and an up-to-date web browser with JavaScript enabled. It is prohibited to use the contact form to send unlawful content, unsolicited commercial information, or in an automated manner.
4. Inquiry and conclusion of the agreement
Sending an Inquiry or taking part in an Initial consultation does not constitute the conclusion of an agreement and does not oblige the Client to pay. After learning the Client's needs, the Service Provider presents an offer or a draft agreement specifying the scope, schedule, remuneration and rules of cooperation. A service agreement is concluded when it is signed by both parties or when the Client accepts the offer in writing (including by e-mail), depending on what the parties have agreed.
5. Remuneration and payment
The amount of remuneration, the billing model (fixed price, monthly subscription or hourly rate) and payment terms are specified in each agreement or accepted offer. Remuneration is quoted net and increased by VAT at the applicable rate, unless the offer expressly states otherwise. Payment is made by bank transfer to the account indicated on the invoice, within the period specified in the agreement or on the invoice.
6. Confidentiality and liability
Information about the Client's infrastructure, systems, processes and organisation obtained during the Initial consultation, audits or other Services is treated by the Service Provider as confidential and used solely to perform the Services. Detailed confidentiality rules, the scope of the parties' liability and the rules of access to the Client's environments are set out in the agreement or in a separate non-disclosure agreement (NDA). The Service Provider is liable for non-performance or improper performance of the Services under the terms of the agreement and applicable law.
7. Right of withdrawal (consumers)
If the Client is a consumer, or a sole trader for whom the agreement is not of a professional nature, and the agreement was concluded at a distance or off-premises, the Client may withdraw from it within 14 days of its conclusion without giving a reason, in accordance with the Polish Act of 30 May 2014 on Consumer Rights. To exercise this right, the Client must inform the Service Provider by an unequivocal statement (e.g. an e-mail to [contact e-mail]). The right of withdrawal does not apply if the Service has been fully performed with the Client's express consent before the withdrawal period expired.
8. Complaints
Complaints regarding the operation of the Website or the Services may be submitted to: [contact e-mail]. A complaint should include the Client's details and a description of the issue. The Service Provider handles complaints within 14 days of receipt and informs the Client of the outcome by the same channel.
9. Intellectual property
The content, layout, logo and other elements of the Website are protected by copyright and belong to the Service Provider or its partners. Copying and distributing Website content for commercial purposes without the Service Provider's consent is prohibited. The rules for using reports, documentation and other results of the Services are set out in the agreement.
10. Personal data
The rules for processing the personal data of Clients and Website users are described in the privacy policy.
11. Final provisions
The Service Provider may amend these terms by publishing a new version on the Website; agreements concluded before the amendment are governed by the terms in force on the day of their conclusion. Matters not regulated by these terms are governed by Polish law, in particular the Civil Code, and, with respect to consumers, also the Act on Consumer Rights.
